The Register of Damage for Ukraine has officially opened the possibility of submitting claims for compensation of damage caused by the aggression of the Russian Federation against Ukraine in new categories. These categories relate to damage to or destruction of immovable property owned by the State of Ukraine (B categories) and Legal Entities (C categories):
- B1.3 and C1.3 – Damage or Destruction of Residential Immovable Property – Residential Areas
- B1.4 and C1.4 – Damage or Destruction of Residential Immovable Property – Common Use Areas
- B1.5 – Damage or Destruction of public buildings and facilities
- C1.5 – Damage or Destruction of non-residential immovable property (not related to business losses).
Categories B (The State of Ukraine): claims can be submitted by the State of Ukraine, including its central, regional and local authorities, as well as legal entities owned or controlled by the State or municipal authority.
Categories C (Legal Entities) are available to legal entities established under the laws of Ukraine or any other state (except the Russian Federation), regardless of the organisational and legal form and form of ownership, including associations of co-owner of multi-apartment buildings, housing construction cooperatives, public associations, charitable and religious organisations.
For which damages a claim can be submitted
Claims in these categories can be submitted for compensation for damaged or destroyed immovable property, namely:
- Residential Areas (B1.3 and C1.3): These categories mirror the previously opened category for individuals (A3.1). They cover the damage to or destruction of individual residential areas (such as apartments, houses, corporate or institutional housing) owned by the State, municipal authorities, or Legal Entities. Claims in these categories can be submitted only for the value of the destroyed property or for the cost of repairs or reconstruction of the damaged property.
- Common Use Areas in residential buildings (B1.4 and C1.4): These categories complement compensation for residential areas. They cover the damage to or destruction of common areas and structural elements of multi-apartment buildings and dormitories, including lobbies, staircases, roofs, lifts, basements, utility rooms, facades, and engineering systems. These objects constitute a significant part of the building's material value, and the costs incurred for their restoration, maintenance, or major repairs are subject to proper documentation and compensation.
- Public buildings and facilities (B1.5): This category covers buildings and facilities for governmental functions owned by the State of Ukraine (including its regional and local authorities, State-owned or controlled entities) that are not classifies as infrastructure facilities (such as administrative buildings, cultural and sports facilities). A claims can be submitted only for the value of the destroyed building or facility or for the cost of repairs or reconstruction of the damaged building or facility.
- Non-residential immovable property of Legal Entities, not related to business losses (C1.5): This category is designed for Legal Entities whose non-residential immovable property was damaged or destroyed, provided that such property was not used directly or commercial activities aimed at generating profit. In particular, this applies to non-residential buildings, premises, and structures used for public, charitable, humanitarian, religious, or social activities. Claims concerning commercial real estate and other direct business losses are to be submitted under category C3.1, which is already opened for submission.
The opening of these categories creates the opportunity to systemically document such losses and to form a complete international evidentiary base, on the basis of which decisions on compensation will be made.
How to Submit Claims
Claims are submitted via the Diia web portal.
Claims on behalf of a Legal Entity or a state authority may be submitted by the head of the Legal Entity (for example, director or chairperson), who is named as such in the Unified State Register, using their own qualified electronic signature (QES).
The director or chairperson may also appoint a Representative, who will be authorised to submit claims on behalf of the legal entity, by granting such Representative Digital Authority via Diia.
